We are experienced in trusts & estates laws. We can provide you with an estate plan that meets your specific needs and considers tax saving mechanism to your highest benefit. Although each person's estate plan varies, our estate plan package generally consists of a Trust, Pour-Over Will, Durable Power of Attorney, Advance Health Care Directive and property transfer documents. We are able to guide you in your process and help you understand the fundamentals of a good estate plan and how each tool assists in you in reaching those goals. We also provide services in the area of Trust administration. A Trustee should seek the advise of an attorney during his/her administration of the Trust to make sure that he/she is complying with the provisions of the Trust and the law.

We also are experienced in Probate administration and litigation. When loved ones leave their estate without a Trust, their estate falls under the supervision of the Court and administered through Probate. We can help the personal representative (either the executor or the administrator) of the estate with the smooth administration of Probate. In general, we will assist you with seeking appointment of the personal representative, marshaling probate property, paying debts of the estate, selling property, accounting to the court, and distributing remaining assets according to the decedent's will or as required by law.

During the administration of a probate or trust, issue arise between parties such as between the fiduciary (e.g., executor or trustee) and the beneficiary. If not informally resolved, those issue may result in litigation. Our office can assist you in bringing an action contesting the validity of a will or trust, litigating against a fiduciary for the breach of their fiduciary duties, petitioning for a full accounting, and other issues. We are also experienced in defending against such actions.

We are experienced in conservatorship matters. Unfortunately, there are times when a person is unable to protect or manage his/her own finances or his/her own personal care. A father may be suffering from an disease such as Alzheimer's or dementia. A husband may be in a coma from an accident. A sister may be suffering for an illness that caused a physical disability. Whatever the case may be, it is a time when that person needs help.

In order to provide help, a conservatorship may be necessary. A conservatorship is a court-supervised process of protecting and managing the personal care or finances of someone who has been found to be unable to do so for himself or herself (known as the Conservatee). The court will appoint a Conservator (e.g., family member, friend, or professional conservator) to carry out these duties.

During these tough and trying time, we can help you with a smooth conservatoship process. We can help you petition the court to be appointed as the Conservator. Once appointed, we can help and advise you in carrying out the multitude of duties, such as marshaling and managing assets, reporting to the court, preparing accountings, and preparing various legal documents for the benefit of the Conservatee.
